Scrap Metal Licencing
The Ministry regulates the Scrap Metal Trade in Fiji, particularly the non-ferrous and Public Infrastructure Metal (PIM) trade. The scrap metal industry is regulated by the Scrap Metal Trade Act (‘Act’) 2011.
The Act is in place to address the theft and illegal trade of PIM being sold as scrap metal. Any person or body willing to sell PIM or non-ferrous scrap metal must make an application in writing, duly addressed to the Licensing Authority, (i.e. Permanent Secretary for Commerce, Trade, Tourism and Transport). All traders of the scrap metal, either buyer or the seller must ensure that the execution of scrap metal trade is in accordance with the applicable Act, as mentioned above.
Pursuant to Part 3 of the Act, the Licensing Authority in its discretion, shall grant a licence to an applicant, or renew licence to eligible applicants or revoke the license should the dealer commits an offence under the Act. Should any individual or licensed scrap metal company found guilty of offence under the Scrap Metal Trade Act shall be liable for legal consequences, that may include fine not exceeding $10,000 or 5 years imprisonment or both for individuals and in the case of a company, a fine not exceeding $100,000 shall be imposed. The Act also emphasis on proper record keeping as well.
It is the utmost responsibility of the licensed scrap metal dealers willing to buy non-ferrous or PIM must ensure that the sellers have obtained a one-off ‘Special Approval’, duly issued by to the Licensing Authority to execute the trade.
